Brett Kavanaugh and His Accuser Say They’re Willing to Testify

By Sheryl Gay Stolberg and Julie Hirschfeld Davis

Sept. 17, 2018

WASHINGTON — President Trump’s Supreme Court nominee, Judge Brett M. Kavanaugh, and the woman who has accused him of sexual assault said on Monday they are willing to talk to the Senate Judiciary Committee about the accusations, setting up a potentially explosive public showdown just weeks before the midterm elections.

Mr. Trump vigorously defended his nominee, calling him an “outstanding” judge with an unblemished record, and dismissing as “ridiculous” the prospect that Judge Kavanaugh might withdraw his nomination. Nevertheless, he told reporters that he was willing to accept a delay in the judge’s path to confirmation in order to air the new information.

“He is somebody very special; at the same time, we want to go through a process, we want to make sure everything is perfect, everything is just right,” Mr. Trump told reporters at the White House. “If it takes a little delay, it will take a little delay — it shouldn’t certainly be very much.”

The willingness of accuser and accused to testify publicly carried the potential for a high-profile hearing over the charge, with a lifetime appointment to the Supreme Court at stake. Judge Kavanaugh’s accuser, Christine Blasey Ford, has said Judge Kavanaugh sexually assaulted her at a social gatheringin the 1980s when they were both teenagers. In a letter to Senator Dianne Feinstein of California, the top Democrat on the Judiciary Committee, made public by CNN on Sunday, Dr. Blasey, a research psychologist, wrote, “Brett Kavanaugh physically and sexually assaulted me during high school in the early 1980s.”

The letter sent official Washington reeling on Monday, intensifying what had already been a nasty partisan battle over Judge Kavanaugh’s confirmation. With the Senate Judiciary Committee scheduled to vote on the confirmation Thursday — a vote that now looks as if it will almost certainly be delayed — Senator Mitch McConnell of Kentucky, the Republican leader, took to the Senate floor to angrily assail Democrats for raising the allegations at the last minute.

“If they believe Judge Kavanaugh’s accuser, why didn’t they surface this information earlier so that he could be questioned about it?” Mr. McConnell asked. “And if they didn’t believe her and chose to withhold the information, why did they decide at the 11th hour to release it?”

Senator Chuck Schumer of New York, the Democratic leader, demanded an F.B.I. investigation of Dr. Blasey’s accusations and raised questions about Judge Kavanaugh’s veracity — a theme that Democrats had already been pursuing in the wake of the judge’s confirmation hearings.

“There’s an issue of credibility here,” Mr. Schumer said in remarks on the Senate floor. “You have two people with diametrically opposed views as to what happened. And this is not just an argument for its own sake. It’s for a nomination to the Supreme Court, the highest court in the land.”

Washington’s public relations machinery also sprang to life. A conservative advocacy group said it would spend $1.5 million on a television advertising campaign to defend Judge Kavanaugh, while a liberal group announced a $700,000 ad buy intended to pressure senators in swing states. Allies of Judge Kavanaugh made public letters from two ex-girlfriends, attesting to his character, while a hashtag sprang up on Twitter: #BelieveChristine.

Senators of both parties called for Dr. Blasey and Judge Kavanaugh to testify publicly. Instead, Senator Charles E. Grassley, Republican of Iowa and the Judiciary Committee chairman of the Senate Judiciary Committee, said Monday that he would arrange telephone calls to allow Republican and Democratic aides to interview both Judge Kavanaugh and Dr. Blasey — a plan Mr. Schumer promptly rejected.

”Anyone who comes forward as Dr. Ford has deserves to be heard, so I will continue working on a way to hear her out in an appropriate, precedented and respectful manner,” Mr. Grassley said, referring to Dr. Blasey by her married name.

But Mr. Schumer said committee staff were ill-equipped to assess allegations of sexual misconduct, adding that Democrats would not “participate in this biased, far-fetched process.”

Mr. Grassley also took a shot at Senator Dianne Feinstein of California, the top Democrat on the committee, for withholding the information about Dr. Blasey until last week.

“Unfortunately, committee Republicans have only known this person’s identity from news reports for less than 24 hours and known about her allegations for less than a week,” Mr. Grassley said. “Senator Feinstein, on the other hand, has had this information for many weeks and deprived her colleagues of the information necessary to do our jobs.”

Mr. Trump, too, criticized Democrats for failing to raise the allegation earlier, saying, “it’s very unfortunate they didn’t mention it sooner.”

“They’ll go through a process and hear everybody out,” Mr. Trump said of members of the Senate. “I think it’s important. I believe they think it’s important.

Behind the scenes, though, the White House was working feverishly to prevent the accusation from slowing Judge Kavanaugh’s confirmation. Donald F. McGahn II, the White House counsel who is shepherding his nomination, was focused on preserving plans for a Thursday vote to confirm Judge Kavanaugh, according to a person familiar with the planning, who said he was making the case to senators that they should not allow themselves to be “pushed around by an 11th-hour allegation” to stop the process in its tracks.

Public hearings could be fraught, especially in a political year marked by surging female political activism and a surge of female candidates. No Republican women serve on the Judiciary Committee, and senior Republican men appeared ready to defend the nominee.

“I believe him,” Senator Orrin G. Hatch, a Utah Republican on the Judiciary Committee, told reporters after a private phone call with Mr. Kavanaugh Monday afternoon. Mr. Hatch said he saw “lots of reasons” not to believe Dr. Blasey’s accusation.

“He is a person of immense integrity,” the senator said. “I have known him for a long time. He has always been straightforward, honest truthful and a very, very decent man.”

“It would be hard for senators to not consider who the judge is today, because that is the issue,” Mr. Hatch continued. “Is this judge a really good man? And he is, and by any measure he is, and everybody who knows him says he is.”

Judge Kavanaugh has denied Dr. Blasey’s allegations, and in a statement on Monday, said: “I have never done anything like what the accuser describes — to her or to anyone. Because this never happened, I had no idea who was making this accusation until she identified herself yesterday.”

Mr. Trump’s counselor, Kellyanne Conway, said that she had spoken with the president and members of the Senate Judiciary Committee and that the woman “will be heard.”

Aides to Mr. Grassley have said he intends to schedule follow-up telephone calls with Democratic and Republican aides, who could interview both Judge Kavanaugh and Dr. Blasey — a practice he called “standard procedure” in Monday’s statement. But he said Ms. Feinstein has refused to work with him to schedule the calls.

Ms. Feinstein had withheld the news about the accusations at Dr. Blasey’s request.

Calls for delaying the Senate’s vote on Judge Kavanaugh, planned for Thursday, grew Monday morning. Republicans had hoped to confirm Judge Kavanaugh before the midterm elections in November, when their control of the Senate could slip away.

Ms. Conway, speaking Monday to Fox & Friends, said the Senate Judiciary Committee would decide when and how Dr. Blasey’s testimony would be heard.

“So, let me make very clear,” Ms. Conway said. “I have spoken with the president. I have spoken with Senator Graham and others. This woman will be heard.” Ms. Conway referred to Senator Lindsey Graham, a member of the Judiciary committee, which is considering Judge Kavanaugh’s confirmation this week.

Democrats say the vote should be delayed so that the committee can hear Dr. Blasey — a move Republicans have said is a stalling tactic. Judge Kavanaugh’s confirmation hearings have drawn raucous protests and partisan fights, even before Dr. Blasey’s allegations became public.

Dr. Blasey was willing to testify before Congress, Debra Katz, a lawyer, said on Monday about her client, who has been referred to in news accounts as Ms. Ford but goes by Dr. Blasey professionally.

“We hope that this hearing is fair and not another weaponized attack on a woman who has come forward with allegations of sexual misconduct against a powerful man,” Ms. Katz told The New York Times.

There was no indication early Monday that the Judiciary Committee had requested such testimony or that the panel planned to delay the vote.

A key Republican on the committee, however, Senator Jeff Flake of Arizona, told Politico that he was “not comfortable voting yes” on Judge Kavanaugh’s nomination until he learned more about Dr. Blasey’s account. Mr. Flake’s objection could force a delay for the committee, which has 11 Republicans and 10 Democrats.

Senate Republicans have also expected they could win the support of some Democrats who face tough re-election campaigns in states Mr. Trump won in 2016. One such Democrat, Senator Joe Donnelly of Indiana, said on Monday that the allegations against Judge Kavanaugh were “serious and merit further review.”

In the letter, Dr. Blasey, 51, a research psychologist at Palo Alto University in Northern California, described how the future Judge Kavanaugh and a friend, subsequently identified as Mark Judge, cornered her at a gathering of high schoolers in Montgomery County, Md. Both were a year or two older than her at the time, she wrote. Mr. Judge’s name is redacted from the letter.

“Kavanaugh physically pushed me into a bedroom as I was headed for a bathroom up a short stair well from the living room,” Dr. Blasey wrote. “They locked the door and played loud music precluding any successful attempt to yell for help.”

The letter went on: “Kavanaugh was on top of me while laughing with REDACTED, who periodically jumped onto Kavanaugh. They both laughed as Kavanaugh tried to disrobe me in their highly inebriated state. With Kavanaugh’s hand over my mouth I feared he may inadvertently kill me.”

The letter said the friend “said mixed words to Kavanaugh ranging from ‘go for it’ to ‘stop.’ ” Mr. Judge has said in an interview with The New York Times that no such assault took place.

Dr. Blasey wrote that at one point, when the friend jumped on the bed, “the weight on me was substantial. The pile toppled, and the two scrapped with each other. After a few attempts to get away, I was able to take this opportune moment to get up and run across to a hallway bathroom. I locked the bathroom door behind me. Both loudly stumbled down the stair well at which point other persons at the house were talking with them. I exited the bathroom, ran outside of the house and went home.”

The letter tracks with an interview that Dr. Blasey gave to**The Washington Post, in which she said that a drunken, teenage Mr. Kavanaugh pinned her on a bed, groped her and covered her mouth to keep her from screaming.

“I thought he might inadvertently kill me,” the newspaper quoted her as saying. “He was trying to attack me and remove my clothing.”

Dr. Blasey came forward publicly over the weekend, putting her name behind accusations that had been shared with the top Democrat on the Senate Judiciary Committee on the condition that she remain anonymous.

Ms. Feinstein received Dr. Blasey’s letterin July, after Dr. Blasey shared it with her local congresswoman, Representative Anna Eshoo, a Democrat of California.

The letter and its contents were shared only with a small group of Capitol Hill aides. The issue was not raised during Judge Kavanaugh’s days of testimony before the Senate Judiciary Committee, even though by that point the letter was an open secret on Capitol Hill.

Ms. Katz told NBC on Monday that Dr. Blasey believes what she said Mr. Kavanaugh did to her was attempted rape.

On Monday, a White House spokeswoman reiterated Judge Kavanaugh’s denial of the incident.

“On Friday, Judge Kavanaugh ‘categorically and unequivocally’ denied this allegation,” the spokeswoman, Kerri Kupec, said in a statement. “This has not changed. Judge Kavanaugh and the White House both stand by that statement.”

Advisers to the president have privately urged Mr. Trump, who has been accused of sexual harassment by more than a dozen women, not to address the allegations on Twitter, his favorite public platform. Early on Monday morning, Mr. Trump was busy retweeting updates about the storm, Florence, that hit the Carolinas over the weekend.

Kavanaugh is the biggest hypocrite as he supposedly was trying to sell himself as an honest and very conservative man. Well now him and Dr. Christine Blasey Ford will be testifying on Monday. It will be a very big issue for Kavanugh as he has lied about this affair not occurring. How can anyone trust and ten expect to nominate him accordingly:

Or you are mistaken.
Whether that is true or not remains to be seen.

Two women who dated him in High School/college and know him are standing up for him.

Right now I'm waiting for the testimony but unless no one else comes forward with information and or other provable allegations I think my conjecture of her bring mistaken will be correct.

I don't know. I'm waiting to see the testimony.
So then Kavanaugh could be the one who is mistaken. But was he right to categorically deny those incidents, especially if all the evidence points to Ford actually telling the truth??

Read this part again, before you ask that question:

"While Ford initially sought to keep her allegation confidential, she said she opted to go public once the allegation emerged in the public eye and reporters began pursuing her. Her attorney, Debra Katz, told CNN that Ford would be willing to testify before Congress and stood by her story in the face of expected push-back.
Katz described Ford's recollection of the incident in stark terms, going as far as saying her client considered it an attempted rape.
"She believes that but for his inebriation and his inability to take her clothes off, he would have raped her," Katz said.

Why are the FBI then conducting this investigation and these two are testifying???????

Again, the right wingers will always blame the Democrats. But hypocrite Trump involved the Clinton accusers during the debate v Hillary Clinton. That seemed perfectly normal to the right wingers.

If she show can show evidence beyond uncooborated testimony it should be weighed.

And her councilling sessions don't qualify.

I don't believe one word she says. It's Clarence Thomas all over again, only this accuser has even less credibility. She had plenty of chances to seek justice. He has been in the public eye for almost two decades. Coming out at the Supreme Court hearings, through a letter(who the fuck writes letters, anymore?) to a partisan hoe tells me all I need to know. Should she be believed? As much as Bill Clinton's accusers were believed. Fair's fair.

However, he has been the subject of six full scale FBI background checks which have turned up nothing. If you have ever been the subject of such a background check you would know that they manage to find out things that you wonder how the Hell they ever found that out!

How can you possibly assert that he is lying? He's been in public service for almost 3 decades. Gone through 6 FBI background checks. Not a shred of anything remotely negative about his character. 65 women from both his past and present have gone on record supporting him.
This is nothing more than a political hit job orchestrated once again by the (Un)Democratic Party. We've seen it before, most recently with Roy Moore, and of course with Justice Thomas back in 1991. This could backfire huge on the Democrats and they can't even see it. So desperate to regain power and impeach Trump.
Sen Fienstein needs to account for why she held on to the letter since July. Didn't say anything through the hearings. Why? Because they didn't intend to use this. It's a last ditch desperate ploy to derail the nomination.
