CHESTERFIELD, Va. (AP) - A Virginia judge decided not to impose any active prison time for a 19-year-old man who prosecutors say tied up a 14-year-old girl and sexually assaulted her after they attended a school play.

The Richmond Times-Dispatch reports that in January, Chesterfield Circuit Judge T.J. Hauler sentenced Logan Osborn to 10 years in prison with eight years suspended. But in January and again Wednesday, Hauler stayed execution of the two-year active term, noting that guidelines called for no incarceration.

Osborn pleaded guilty to having carnal knowledge of the girl in an agreement in which prosecutors wouldn't pursue a forcible sodomy indictment.

Osborn's attorney says it was consensual, but prosecutor Erin Barr says at 14, the girl couldn't legally consent to sex.

Barr said the family is disappointed Osborn will serve no prison time.

Osborn, who will be required to register as a sex offender, lost an academic scholarship to study chemistry at the University of Mary Washington because of the conviction.

Prosecutors said Osborn forced himself on the victim after getting her alone and tied a belt around her neck and hands before the assault.

Osborn's attorney has described the sexual encounter as consensual and said that a series of text messages the girl and Osborn exchanged "supports his version of the facts."

According to evidence in the latest case, Osborn and the victim met for the first time at a prom. One week later, on April 28, 2017, they attended a play together at Cosby High School at Osborn's invitation.

The play ended earlier than expected, and Osborn and the girl went for a walk. Chesterfield prosecutor Erin Barr said Osborn led the girl down a path from where people were gathered for a sporting event. The path ended at a fence. Barr said Osborn pushed the victim to her knees and tied a belt around her neck and hands before forcing her to perform a sex act.

When it was almost time for the girl's mother to pick her up, Osborn untied the victim and let her up. She quickly walked back to the school and spoke with her mother by video chat, the prosecutor said.

Upon seeing her daughter, the mother knew something was wrong. Osborn followed the girl back to the school and then left for home, Barr said.

The girl's mother immediately questioned her about what happened. The girl told her mother on the way home what Osborn did, and the family called police and took her to St. Mary's Hospital for a forensic exam, the prosecutor said.

I think this story is a little misleading and we need more facts. The question is why was the 8 years suspended? Credit for time served? Nature of the offence? Supposed consent? Yes the end result was no jail time but there are some holes in the middle.

To me, the judge might have made a stupid mistake since the guidelines call for no prison for the two year term. Was his/her goal to somehow give this creep no jail time?

And when I hear stories like this, I'm wondering how a 14-year old girl ended up going anywhere with a 19-year old guy. Clearly something wrong with it. It's sad but situations like this are the reason I'm pissed about the Conservatives killing the new sex ed program. This happened in the US but could easily happen here too. How educated was the girl?

Some guys have all the luck eh. How many times have we seen guys like this escape proper punishment. Still remembering the mentally challenged kid who got the coat hanger through the back end and his attacker get off with no jail time.

This young girl's fatih in society was just shot down. She went through all that and was left with nothing but worse feelings for her troubles. Victimized in the event, then the additional trauma of hotispials, police, interviews, questions. Then court and testifying and facing her accuser and now he gets a suspended sentence and you have more idiots who will continue to blame the victim or the victims parents with comments like we have already seen here.

Society should be so proud....

ANYONE has the right to change their mind at ANY time during a sexual encounter, even if it *might* have seemed like something they wanted to try at first (I say "might" because I don't have the facts for this case). If she's crying afterward and immediately calling her mom and they take her to the hospital for a forensic investigation, that doesn't sound like consent was maintained throughout to me.

I wish men would get it through their heads: consent requires ongoing validation to remain in effect, and she doesn't necessarily have to scream "No! Get off / Let Go of me!" to notice/realize you're RAPING her.

Let me clarify. Do you think a drunk 15 year old will exercise more/less judgment than a drunk 18-year old or a drunk 30 year old? Generally speaking the answer is no, they all lack sufficient capacity to judge, to consent, etc. So restricting alcohol or drugs based on age has nothing to do with their ability to function when high/drunk. It therefore comes down to effect on the body and younger people's bodies get affected more when exposed to the same substance as an adult.

Give me two people of any age, put alcohol into the mix, and chances are the result will be in the same neighbourhood.

So since adulthood has everything to do with maturity to understand, think, and make choices, using the argument of alcohol being 19 in Canada and 21 in the US doesn't work.

Age of consent in Canada is 16 (used to be 14) so pretty sure there might be a crime in that regards. But if the girl is saying she was raped, it was a crime in any country. This is not a case of a 19 year old having consensual sex with a 14 year old and being charged with statutory rape, a charge laid regardless if the underage individual was totally fine with it. In this case, the girl complained to her mom after being tied up. Let's say it was her first time - do you think anybody goes for one of the more extreme fetishes on their first try? Not likely.
