Michael Avenatti’s coffee chain fired a top-performing store manager in July 2016 because she became pregnant, a court found according to documents obtained by The Daily Caller News Foundation.

A Washington state court on Oct. 13, 2017, ordered the parent companies for Tully’s Coffee chain to repay the woman $80,000 in lost wages and $40,000 in damages for the “pain and suffering” after her unlawful termination, court documents show.

Both parent companies, Global Baristas, LLC and Global Baristas US, LLC, are either directly or indirectly controlled by Avenatti, according to government records reviewed by TheDCNF.


The woman, Elizabeth Eno, worked for the chain from 2012 until she was fired in July 2016, shortly after she informed her supervisor that she became pregnant, according to court documents.

Eno informed her supervisor around “the beginning of July 2016” that she was pregnant, court documents show. On July 5, the expectant mother “was evaluated by a secret shopper” and scored an 89 percent, court documents show.

But two days later, the woman’s supervisor told her that she had, in fact, fared poorly in the evaluation and informed her that she had been fired, the court found. This was roughly a week after she had revealed her pregnancy to her supervisor.

The defendants “failed to provide a justification for Ms. Eno’s termination based on poor job performance or to further a legitimate business necessity,” the court found.

Before she was fired, Eno had recently been ranked the second-highest performing store manager in the district and tenth-highest in the entire company, according to the court’s statement of facts.

The court stated as fact that the coffee chain “unlawfully discriminated against Ms. Eno when she was terminated due to her pregnancy.”

She was awarded $80,000 to recover “lost wages due to being unable to secure equal employment.”

“Additionally, as a result of Defendants’ actions, Ms. Eno experienced pain and suffering due to being pregnant and having a child while unemployed and unable to take leave under the Family Medical Leave Act,” the court found, awarding the woman $40,000 in damages.

Avenatti acquired Tully’s Coffee chain in 2013 in a business partnership with movie star Patrick Dempsey, who sued Avenatti less than two months later. Dempsey accused Avenatti of misrepresenting the company’s available capital and then secretly using the company’s assets to secure a $2 million loan. Avenatti denied that claim but three days later agreed to a settlement that allowed Dempsey to walk away from the company.

Avenatti’s spokesperson told the Seattle Times on March 8 that he “divested his interest in Tully’s nearly a year ago.” The paper noted that Avenatti publicly described himself as the company’s head as recently as July 2017. Avenatti hasn’t said when he sold his share in the company, or to whom.

Global Baristas LLC, is controlled by the similarly named Global Baristas LLC — which Avenatti currently controls, according to Washington state records reviewed by TheDCNF.

Both companies were listed as defendants in the lawsuit.

“Defendants Global Baristas, LLC and Global Baristas US are liable to the Plaintiffs for all damages in the total amount of $120,585.00,” the court concluded.

The companies declined to appear in court or respond to the ruling, forcing the court to order the award’s garnishment from the company’s bank account, court records show.

“I have no idea. I had nothing to do with that case,” Avenatti said in an email to TheDCNF on Thursday. He declined to identify who, if not him, currently owns Tully’s Coffee. Avenatti remains the company’s general counsel, he said in a phone interview on May 10.

The sex discrimination case against Global Baristas was first noted on Nov. 13, 2017, by a local Seattle blog, which didn’t tie Avenatti to the company or note that the woman was allegedly fired for being pregnant.

Although Avenatti has said that he no longer has a financial interest in Tully’s, it remains unclear just how involved he is with the financially embattled coffee chain. Avenatti “described himself as the principal or chairman of the Tully’s chain” in April and July 2017, the Seattle Times reported this past April.

Former Tully’s store manager Robert Sifuentez told the Seattle Times that Avenatti’s “name was the only name on my paycheck … up until we closed,” which was in March of this year. As noted above, Avenatti is still listed as the governing interest for the parent company of Tully’s parent company.

Michael Avenatti being investigated by California State Bar

The State Bar of California is investigating porn star Stormy Daniels’ lawyer Michael Avenatti, Fox News has confirmed, after a complaint was filed regarding allegedly unpaid taxes.

Fox News on Wednesday obtained an April 18-dated letter verifying the existence of the investigation—unrelated to his representation of Daniels.

“The complaint against attorney Michael J. Avenatti has been reviewed and forwarded to the Enforcement Unit for further investigation and prosecution, if warranted,” said the letter from the state bar, written by Supervising Attorney Anand Kumar and reviewed by Fox News.

The letter also provided the names of the investigators reviewing the complaint.

The State Bar of California declined to comment on the letter, when reached by Fox News.

The complaint itself was filed in late March by attorney David Nold of Bellevue, Wash., regarding Avenatti's role in purchasing Tully’s Coffee several years ago through an entity called Global Baristas.

The complaint, first reported by The Seattle Times, said Avenatti and Global Baristas faced a lien for unpaid federal taxes worth roughly $5 million, claiming taxes were withheld from workers’ paychecks but not paid to the government. The complaint from Nold, as posted by The Seattle Times, called into question Avenatti’s “fitness to practice law.”

Calling Out The Daily Caller, Part 1

The first of a two-part series on why Tucker Carlson’s news site’s race coverage is as bad, if not worse, than Breitbart

We need to address the vessel of shitty reporting, the life raft of tea party lawyers and fledgling Tomi Lahrens and Richard Spencers in need of a byline, that is The Daily Caller.

The Daily Caller isn’t journalism. It’s racist propaganda, top to bottom.

Its “thought-provoking commentary” is white rage designed to fuel their racist following. Heck, their editorial board features so many white nationalists and people with significant ties to such groups that the Southern Poverty Law Center declared the site has a “white nationalist problem.”

Deputy Editor Scott Greer spent his younger years cavorting with white nationalist groups like Youth for Western Civilization. (In addition to defending America’s white students from immigrants and liberals, YWC also defended them from scary lady bits in The Vagina Monologues.) Though the Facebook photos of him with the YWC have since been taken down, Greer still follows and retweets white supremacist celebs like Richard Spencer and alleged cult leader Stefan Molyneux on Twitter.

Greer’s writing betrays his racial politics. He’s not quite as inflammatory as Spencer or former Breitbart editor Milo Yiannopoulos, but his slightly-more-palatable white supremacy is just as potent. He writes about the downfall of white people, especially white men, at the hands of immigrants and minorities in his book No Campus for White Men. Thinly veiled racism runs through all his writing, sometimes more blatantly than others.

White nationalist rhetoric isn’t a big deal for Greer. Racial aggression and gendered violence don’t happen in Greer’s world. It’s easy to just say woman are throwing a tantrum over nothing, like in his reaction to a Dear Prudie column written by a mother fearing her soon-to-be stepson was flirting with the alt-right.

It’s not just The Daily Caller’s editorial leadership that has issues with racism. Contributor Peter Brimelow founded white hate group VDARE, named after Virginia Dare, supposedly the first white child born in the U.S. In his editorial debut at The Daily Caller, he defended Iowa Rep. Steve King for tweeting “We can’t restore our civilization with someone else’s babies.” Brimelow says America is a white nation we should keep it that way. And he doesn’t, by the way, appreciate being called a racist for that assertion.

Reporter Chuck Ross was hired before he took down his racist and sexist ramblings on his personal blog. Editor in Chief Geoff Ingersoll told The Washington Post’s Erik Wemple that he was “unaware” of the blog posts but the site still publishes Ross’s work.

Those old posts include describing the “different natures” between races that explain the disproportionately higher rates of incarcerated black people. His argument: since slaves were “bred” for higher testosterone levels, they’re naturally more aggressive. “It’s nice to think that an individual will behave in accordance with the law, but its[sic] a pipe dream that a whole group will act against their nature to live by the letter of the law,” he wrote on his blog “Gucci Little Piggy.” Black people are in jail because it’s in their nature to be criminals.

Ross, of course, defended himself by telling The Post that he has black friends.

His other blog posts include 1,200 words on why women “don’t create jobs” and spoiler: it’s because by our nature, we’re bad at doing business, lazy and better at being mothers. He also referred to queer feminists as “queefs.”

To counter accusations of racism, The Daily Caller, like Chuck Ross and his black friends, employs black people to make the racist arguments for them. Contributor E.W. Jackson wonders “Should There Be A Black History Month?” He begrudgingly concludes there should be, because slavery, but that it should be balanced with a defense of the confederacy, otherwise “where does it end?”

The Daily Caller agonizes over that same question. Where does it end? When do the social justice warriors finally give up so we can return to the status quo: whites on top.

Jason Kessler’s sympathetic report on protests to preserve a Robert E. Lee memorial in Charlottesville, Virginia, ran in The Daily Caller on May 14. The article had one major problem: Its author is a white nationalist. As A.C. Thompson reports in ProPublica, Kessler was a participant in the protest, giving a talk where he “praised groups such as the American Vanguard, an organization that espouses the eradication of the country’s democratic structure of governance. He hailed Matthew Heimbach, who views himself as a warrior against Jews and people of color, and Sam Dickson, a denier of the Nazi Holocaust who has been involved in racist activities since the 1970s.”

In response to ProPublica’s reporting, The Daily Caller added a note to the article: “The author notified The Daily Caller after publication that he spoke at a luncheon May 14 on behalf of an effort to preserve the monument.”

More troublingly, in its larger response to the controversy, The Daily Caller is taking the position that the original article was fine and the only problem is the conflict of interest—not Kessler’s manifest support for racist politics. As Paul Connor, executive editor of The Daily Caller, told ProPublica, “The story is factually accurate and plainly states what happened at the event. But in light of his activism on the issue, we have mutually agreed to suspend our freelance relationship with him.”

Connor was unwilling to criticize Kessler’s praise of racists, saying, “We pay writers for journalism, not their opinions.” But even if Kessler hadn’t participated in the protest, his commitment to white supremacy, evident in his longstanding activism, obviously has bearing on his journalism.

You can smear him if you want...but at some point you need to be able to respond to the substance of what he’s saying. This consistently proves challenging for Trump and his followers so they are left with shrill smear campaigns and no substance. Trump supporters don’t care, of course...but it it doesn’t play outside of his base.
