Concerns raised after TTC fare inspectors pin rider to ground................

Bystanders are raising concerns about an incident involving TTC fare inspectors and a rider that triggered a large police response on Sunday afternoon.

According to witness Bethany McBride, a boy who looked around 15 years old was getting off the streetcar at St. Clair Avenue West and Bathurst Street, when a fare inspector grabbed him by the back of his coat and dragged him back into the vehicle.

“It looked like he was going to get off and they were making their rounds checking people’s transfers and they wanted to catch him before he made his way off the [streetcar],” McBride said.

“I saw the [teen] react semi-aggressively, in a defensive manner.”

She said the teen shoved the inspector, prompting an altercation, and then the two fare inspectors dragged the kid off the streetcar and pinned him to the ground.

Police were called to assist, around 4:30 p.m., and when they arrived they found a large crowd had gathered around the inspectors and the boy, who is Black, who was struggling to get free.

In a video McBride shot of the incident, the boy says, “I didn’t do anything, though,” and “You’re hurting me. You’re hurting me.”

She said he didn’t seem to be fighting back or trying to escape and there was blood and dirt on his face.

Officers said they handcuffed the boy because he was resisting and refused to put his hands behind his back — and they escorted him next to a squad car where it was quieter.

The boy was visibly upset and identified himself to officers.

Police found the boy hadn’t committed any criminal offence and immediately released him.

TTC spokesman Stuart Green said fare inspectors should only be using force as a “defensive mechanism.”

“They would never, for example, physically remove someone for not paying a fare,” he said.

“What we’ve seen in the video is, of course, of great concern to us.”

Green said the TTC is investigating — including reviewing surveillance video of the incident and questioning the fare inspectors — and will take “appropriate action.”

This was a massive over-reaction by the fare inspectors and police. Is it necessary to grab people by the neck and pin them to the ground? Getting shoved is not acceptable, but it's part of the job as a fare inspector and police. I would hope they have a cool enough head to know the difference between getting shoved and someone fighting with them.

I also can't believe the it takes almost a dozen cops and multiple cruisers blocking the tracks to arrest one boy. Must have been a quiet day at the station.

No they are Special Constables and are employed by TTC.
The fare inspectors aren't special constables they are just bylaw enforcement officers. The TTC does have a corps of Special Constables but they are a separate group from the fare inspectors.

The TTC has suspended one of its fare inspectors who was involved in an altercation with a teen passenger on Sunday.

In a letter to Toronto Ombudsman Susan Opler, Acting CEO Richard Leary confirmed the inspector had been suspended with pay pending the outcome of an investigation.

The TTC has also asked Toronto police to determine whether criminal charges are warranted.

Leary said the TTC’s investigation will determine whether the fare inspector violated the Transit Enforcement Unit Code of Conduct by failing to treat customers equally without discrimination, assaulting a customer and using unauthorized force on a customer among other allegations.

Leary said the transit agency will try to complete the investigation as soon as possible, rather than the typical 90 days.

The final report will be delivered to Leary, Opler and the TTC Board.

Sounds like a case of aggravated assault and self defense. Those fare collectors are civilians and civilians cannot conduct a citizen's arrest unless the person being arrested is in the process of committing an indictable offense. Skipping on a $3 fare (whether he did or not) is not an indictable offense. i see a big payoff here, if he gets a half decent lawyer.
