The issue is when a Canadian commits a crime in a foreign country. Should that Canadian be tried under Canadian law or the law of the foreign country where the crime occurred?

Criminal jurisdiction is territorial. So normally, a person is tried in the jurisdiction where the crime is committed. There is a famous case where a guy stood on the Tennessee side of the river and shot a guy standing on the Alabama side of the river. The issue was did the murder take place in Tenn or Ala and which state had the right to try the accused.

But of course, this is subject to the extra territorial jurisdiction set out in s.7 of the Canadian Criminal Code re terrorism offences. Go read those sections and report back, Mr Questions.

We do if you want the state to punish someone. The fundamental deal is that the state can't take away your rights and freedoms without a jury of your peers agreeing.

Give that up and we lose EVERYTHING.

Who gets to decide, if not a jury? Can Trudeau just decide that the conservatives are bad and lock them all up claiming he just knows it?

Khadr could have been tried before a regular Canadian Court with a regular Canadian judge and jury for being a terrorist. But Chretien and Harper blew it by not repatriating him. Instead they left him a Gitmo. And now he gets an apology and a pay off instead of a trial and kiddy-jail, since he was 15 when he committed his crimes.

Section 83 of the Criminal Code, Fasty. Life imprisonment. But your hero Harper fucked up and now you have to give your hard earned money to Omar. And he's going to drive around in a big car and live in Rosedale and not work again for the rest of his life on your dime.

How many threads have discussed innocent people freed after years in jail --- they were found guilty due police or crown misbehavior because some was convinced that there was documented evidence that the individual was guilty. We are supposed to have trials to prove this things

Justice David Watt, a former Crown prosecutor who has a pretty hardball reputation and is not particularly defence friendly, said the trial judge screwed up in the jury selection phase. Apparently Justice Watt - a former prosecutor with decades of experience - believes it's not an open and shut case.

Now I understand that you enjoy yourself whining about issues you don't really understand on a johnboard, but I'd go with Justice Watt's assessment over yours. And that pretty much ends the conversation, doesn't it?

And for the record, exactly the same type of appeal would have succeeded in the US or the UK. I assume that you would also class those places as soft on homicide?
