Preet Bharara, the Manhattan federal prosecutor who was told to submit his resignation along with 45 others on Friday, has no plans to do so — forcing a potential showdown with President Trump and the Department of Justice.

Mr. Bharara, whose office is overseeing a case against a top aide to Gov. Andrew M. Cuomo and an investigation into people close to Mayor Bill de Blasio of New York City, has told several people that he did not hand in a resignation on Friday, as he was ordered to do by the acting deputy attorney general, Dana Boente.

He also does not intend to do so over the weekend, he said in conversations with associates, a move that could force the hand of the Trump administration.

A spokesman for Mr. Bharara declined to comment.

Mr. Bharara was asked by Mr. Trump to remain in his current post in a meeting in late November, a few weeks after the presidential election. Mr. Bharara met with Mr. Trump at Trump Tower, and then addressed reporters afterward, saying that he had been asked to remain and had given the president his promise to do so.

But Mr. Bharara was one of the 46 holdovers from the Obama administration who abruptly received a call on Friday telling him to vacate.

Officials with the White House and the Department of Justice did not respond to requests for comment about how they plan to handle Mr. Bharara.

One of New York’s top elected Republicans voiced support for Mr. Bharara on Saturday.

“Good for Preet, he is doing the job he was appointed to do!” Assemblyman Brian M. Kolb, the State Assembly minority leader, wrote on Twitter.

Assemblyman Steven F. McLaughlin, a Republican who was fond of calling for draining the swamp in Albany long before Mr. Trump embraced that expression, had urged Mr. Trump and Attorney General Jeff Sessions to reconsider on Friday.

“Big mistake,” he wrote on Twitter.

The Southern District of New York, which Mr. Bharara has overseen since 2009, encompasses Manhattan, Mr. Trump’s home before he was elected president, as well as the Bronx, Westchester, and other counties north of New York City.

Mr. Trump last weekend accused former President Barack Obama of wiretapping Trump Tower in Manhattan, an allegation he has yet to back up.

But federal investigators have been examining whether there was a connection between Russian officials and the Trump campaign. Intelligence officials believe that the hacking of emails belonging to the Democratic National Committee and campaign officials for Hillary Clinton was orchestrated by the Kremlin.

I was just about to post that he doesn't have a leg to stand on, so this doesn't surprise me.

His record as U.S. Attorney for the Southern District of New York has been mixed. In general he has been an excellent U.S, Attorney, but his handling of the case of Indian Diplomat Devyani Khobragade has caused no end of problems for the U.S. with India, and in my opinion was ham handed.

Sorry, completely disagree. He did what needed to be done, and shed light on an important issue.

As posted in the thread about it at the time, ham handed -- if the U.S. was truly that upset the way to have handled it was to have declared her persona non grata, not to have caused a still ongoing diplomatic flap between India and the U.S.A.

Two lawyers said the dismissals were not unusual for a new president. Annemarie McAvoy, a former Brooklyn federal prosecutor, says it’s not surprising President Donald Trump might want Bharara gone since there’s a good chance any subpoena seeking information about Trump campaign links to Russians would go through his office. Carl Tobias, a University of Richmond law professor, says a purge of prosecutors is within Trump’s rights.

Sounds to me like you are just playing political football with this. I may be wrong, but its seems that you have no issues with Trump causing a diplomatic flap with the world.

Fooling around with Diplomatic and Consular Immunity is playing a dangerous game, dangerous not least for your own diplomats and consular officers.




As by now posted several times, if the U.S. felt that this was truly a "take it to the mat" issue, then the way to have resolved it was to have had the Secretary of State phone the Indian Foreign Minister and then declare her persona non grata with 120 hours to depart the United States. Not pulling a "Perp Walk" with a Vice- Counsel General and rising start of the Indian Diplomatic Service.

So your idea of "take it to the mat" was to declare her"persona non grata"??? That might not have made the 3rd page of the Diplomat and Concular services newspaper (circulation 1000). Making her do the "perp walk" was effective and was worth the trouble.. I applaude you for trying to take the high road, a but you defend Trump's brand of"diplomacy"?

Your two positions are inconsistent and the only rationale is political.

It is still negatively impacting Indian - U.S. Diplomatic Relations. Further, you are highly naïve if you do not believe that with a 'phone call from the U.S. Attorney's Office her being declared persona non grata wouldn't have been on both the front page of the New York Times as well as the Washington Post.
