Let's play out the scenario. A couple has CONSENTUAL, but unprotected sex. They both know that she is not on birth control. As he gets closer to climax and she senses it, she says:

Using the word "rape" is not appropriate in this context. Rape is considered more of a specific form of sexual assault that involves forced penetration or initial penetration without consent. I'd think it would also encompass continued penetration when consent is specifically withdrawn or one person is asked to stop the act.

So I suppose technically, if the originally consenting woman limited her consent to penetration without internal ejaculation and in this example, specifically asked the male to stop penetration prior to ejaculation then that continuned penetration could be considered rape.

However, our Criminal Code uses the words "sexual assault". And a sexual assault is any sort of unwanted contact or interference with another person that is of a sexual nature.

So, if the woman clearly instructed or limited her consent to penetration without internal ejaculation, and the man did in fact knowingly ejaculate into her then the act of continued penetration and ejaculation should be considered a sexual assault. Pregnancy, fluid-borne deadly infections related to semen are all legitimate reasons to limit consent to no internal ejaculation.

NOT that anyone needs ANY reason to ask their partner to STOP at any time and for no reason at all.



Having said all that.... the OP's imaginary scenario says that he is enthralled in the moment and is "totally ignorant" of what she just said.

If the guy was charged, he may try the defence of not being aware of her retraction of consent. I highly doubt that such a defence would be successful.
