Stripper Licence Bylaw Struck Down

There was an interesting development in Windsor yesterday. Mr. Justice Richard Gates of the Ontario Superior Court overturned the city's stripper bylaw mandating that strippers must pay $466 in licence fees for 2005. The judge maintained that the fees were discriminatory in that the other clothed staff in the stripclubs were not required to be licenced. His analogy of the topless male bartender and the topless female bartender was interesting since the former did not need a licence but the latter did.

This judgement has repercussions in that escorts and their agencies, restaurants, pawnbrokers and fast-food joints will soon be banging on the city licencing board counter with subpoenas demanding changes to their licences. Many escorts complained on other boards about the doubling of their fees this year.

The judgement puts a dent in the city's coffers since these fees would amount to $186400 in fees for 2005. As a result of this judgement, the city may have to refund the 2005 fees to the strippers and licences can no longer be issued pending any appeal that will probably result.
