Canadian "regulations"

OK, I'm both a newbie to this board as well as everything else discussed here. Since I will be traveling on/off to Toronto a bunch this summer/fall, I'm trying to get a handle on the LE regulations. I assume it's been covered before and you can shoot me to that thread. In particular, it is my understanding that outcall is OK in Canada; incall isn't. Does it make any difference if you go through an agency or an independent? What kind of risk (legal) am I dealing with?

Yet, there is a whole lot of talk about incall here also. Anything to know?

I think I understand outcall. Like raven says, having the money on the table is a good policy. You are paying for the lady's time, and if you are lucky enough that she then finds you irresistible, there is no issue with LE.

I don't understand incall quite so well. Can someone please explain, in small words preferably, so I can understand?

What I've placed here is perhaps, not so simply worded as it is direct quotes from the Criminal Code of Canada. You may as well get the straight goods homonger.

An incall in Canada is meant to be any place that is kept for the purpose of prostitution, which place, in the law is called a bawdy house. Theoretically then, this could apply to an independant SP's home, however this scenario is seldom ever acted upon, it is more likely to be the more or less commercial operations where one or many SP's and/or clients may gather to "work".

Now, the facts: Read common bawdy house when it appears below as incall.

197(1) "common bawdy-house" (maison de débauché)
"common bawdy-house" means a place that is
(a) kept or occupied, or
(b) resorted to by one or more persons for the purpose of prostitution or the practice of acts of indecency;

210(2) Landlord, inmate, etc.
Every one who
(a) is an inmate of a common bawdy-house,
(b) is found, without lawful excuse, in a common bawdy-house, or
(c) as owner, landlord, lessor, tenant, occupier, agent or otherwise having charge or control of any place, knowingly permits the place or any part thereof to be let or used for the purposes of a common bawdy-house, is guilty of an offence punishable on summary conviction.

a few quick points:

streetwalkers: as noted, talking to a hooker about sex acts & money is illegal, but not the acts themselves if they are done in a hotel or whatever. for the purpose of the law, a car counts as a public place. best bet is to stay away from this scene, which is pretty dead in any case.

it is illegal to make a contract to buy/sell sex in a public place, which includes on the street, in a car, in a bar, etc.

outcalls: are legal (as in all cases, assuming the girl is not a minor) - if you have a problem, it is more likely to be with hotel security stopping the girl in the lobby!

escorts agenecies are pretty safe, but agencies will not discuss the specific services being offered on the phone so as to avoid "pimping" related laws.

incalls - not legal, see the "bawdy house" section, but this is still pretty safe - rarely are there busts of incall places.

massage parlours: generally safe - it is not legal for any of them to offer FS or BJs, though a few do offer the service. technically, even HJs are not officially permitted. in practicce, it is unlikely you will have any LE trouble if you partake in this hobby.
