Hi,
I wonder if anyone can help. A friend of mine was married to a Massage attendant. She was the bread-winner of the family for 2 1/2 years. They agreed she would carry the family until his business took off.
She has since split, and buddy is a bit angry. He is contemplately two things

1/ requesting alimony payments of $2000/ month for five years

2/ going to REVCAn and say she skipped out in declaring about $180,000 in income in the last 3 years.
I know his actions might just seem mean and vindictive, but does he have a chance in either case?? Any lawyers on the board are welcome to respond, or anyone else?

The courts ususally expect people to be self supporting after a breakup. Payments are much more likely if there are dependents.

The vindictive idea of ratting to Rev Can has a few downsides.

The entire business and anyone they can find will be audited. It is far too likely that someone affected knows someone who is skilled at breaking kneecaps with crow bars. The ex is sure to let everyobe know who squeeled.

There is also the risk of a living off the avails of prostitution charge. He was being supported by someone in the sex trade. She will get the sympathy, not him.

I just don't see how Rev Can can will audit someone in this cash business and be able to prove there was income not delared????

CCRA don't need to find the cash. They can just assess her income based on the average for her profession during the years
in question. Keep in mind also that some of her former employers may have sent records of her earnings to CCRA ( they are required to do that by law ).

What they can do is look at how much money was spent by the subject of the audit. Pretty easy to determine rent, utilities, etc.

Credit cards leave an easy trail. As do bank accounts.

With a gap of 60k a year, it will be a no brainer to prove there was undeclared income.

And once there is proof of fraud, your rights pretty much disappear. They can go back as far as they like.

Following up on the last reply, Revenue Canada (now called the Canada Customs and Revenue Agency or "CCRA") can do a "net worth assessment". This method of assessment is used by the CCRA to go after tax evaders. In general, the assessment involves establishing the individual’s net worth and comparing declared income with living expenses. If the assessment reveals a gap between these amounts, the CCRA will assume that it constitutes undeclared income and will go after the individual for the tax, interest, and penalties, and the onus is on the individual to disprove the assessment. Personally, I don't think vindictive actions are a good idea - what goes around comes around.

Don't mess with CCRA

I recall a case years back when the tax men placed a notorious Winnipeg prostitute under surveillance and estimated her annual income from their observations. They recorded, over a few weeeks, the number of visitors, the time they stayed etc. and if I remember correctly I believe that they even included assessment of her laundry, use of towels, and garbage. She was then required to to pay the income tax on her estimated annual income and fines as well, which were all based upon their calculations.

If they get the scent they can be unrelenting until they get their $$$$$. This was all published in the Winnipeg Tribune (now defunct) and probably the Free Press.

Thanx for all the replies. I believe buddy is leaning towards the "tip" line to hide his identity, although it would be pretty obvious. I don't know, just seems like a sad case and too bad the parties couldn't have worked something out.
