Why is incall illegal in Niagara when it's legal everywhere else?
How can a municipal bylaw supercede the federal criminal code?

Victoria

One thing I've always wondered:

With the Victoria agencies, incall is the accepted norm. You actually pay an extra fee if you want outcall.

When I asked about this on PERB, I was told that "Yes, technically, incall is illegal in all of Canada, but it depends on regional priorities in LE. For example, in one city, if you get caught smoking a joint, you will be punished to the fullest extent of the law. In another city, the cop may just ask you to put it out."

Heck, even in several U.S. cities (mine included), there are incall agencies that have been in business for decades. Unless the neighbors complain or there's something else going on like drugs/slavery, LE either doesn't know or doesn't care.

i am pretty sure LE knows what is going on just that if no one complains or if no one is phsically getting hurt they dont care, they are better off using there time to get the real criminals or going to tim hortons to get coffee

I am from the States but my understanding is that incall is illegal in all of Canada. Incall would qualify as a bawdy house and that is not legal.
"Prostitution is legal in all of Canada, but incalls are technically illegal based on the 1800's Bawdy House law" taken from www.sexworktoronto.com/legal/bawdy.html

My best guess is that in most areas it's overlooked.

Incalls are illegal in Canada and even with all the posts in newspapers, on the internet etc, LE is very aware of it being occurring.
LE leaves it alone since investigation time versus the minor penalties doesn't justify their involvement unless it becomes a very public issue.

So incall is technically illegal in all of Canada, but available.
Then the question becomes: Why is it NOT AVAILABLE in Niagara?

Incall isn't available in NF because when it was offered, other non-incall offering agencies and/or SPs would inform LE on those agencies or SPs that did offer incall. Also some dissatisfied patrons would also inform LE as a way to get even. When LE has their nose put in such a situation, it hasn't ignored it. Therefore, most NF SPs and agencies won't offer incall because it isn't well tolerated by others in the industry. I guess you could say the industry is self-policing itself. So if there is any incall in NF it is not made public knowledge, but most likely exists very discretely for known and trusted discrete clients, and then most likely by indies. Anon1, does that make sense to you now? Such is the situation in NF.

And even if you are a known trusted and discrete client, you still may never be offered incall. When the cost of a room is compared to the cost of legal difficulties and public disclosure it can be viewed as a bit of a bargain, eh? Nobody said this hobby was for those that can't afford it.

If incalls do occur it has usually been posted by many visiting SPs who post they will be doing incalls from their hotel as well as outcalls.

And even if incalls were/are available, why risk posting it?

Just remember discretion is always the best, even if you get lucky enough to get an incall.
